NON-TEACHING STAFF EMPLOYMENT AGREEMENT

This Agreement is made and entered into on this [Date]_____________ by and between:

  1. Syed Hyder Memorial Institute, having its registered office at Noor Abad Colony Hyderpora Srinagar, hereinafter referred to as the "Employer," which expression shall include its successors and assigns,
    AND
  2. _____________________________[Non-Teaching Staff Name], son/daughter of [Parent/Guardian Name]____________________________________, residing at [Address] _________________________________________, hereinafter referred to as the "Employee," which expression shall include their heirs and legal representatives.

WHEREAS:

  • The Employer desires to engage the services of the Employee as [Designation, e.g., Clerk, Peon, Librarian, etc.]______________________________________________ in accordance with the terms and conditions set forth in this Agreement.
  • The Employee agrees to be employed by the Employer under these terms and conditions.

NOW, THEREFORE, both parties agree as follows:

1. APPOINTMENT

The Employer hereby appoints the Employee to the position of [Designation]_______________________, and the Employee accepts this position, subject to the terms and conditions mentioned in this Agreement.

2. NATURE OF WORK

The Employee shall perform the duties and responsibilities assigned by the Employer, including but not limited to:

  • Complying with the Employer's policies, rules, and regulations.

3. TERMS OF EMPLOYMENT

4. WORKING HOURS

5. REMUNERATION

The Employee shall be entitled to the following benefits, subject to the Employer's policies:

7. CONFIDENTIALITY

The Employee agrees to maintain the confidentiality of all information related to the Employer and the school and not disclose it without prior written consent.

8. TERMINATION

a. The school authority may terminate this Agreement by giving [Notice Period, e.g., 30 days] written notice.
b. The Employer may terminate this Agreement without notice in case of:

  • Gross misconduct.
  • Breach of terms of this Agreement.
  • Violation of school policies.

9. DISPUTE RESOLUTION

Any disputes arising from this Agreement shall be resolved amicably. If unresolved, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The decision of the arbitrator shall be final and binding.

10. MISCELLANEOUS

a. Amendments to this Agreement shall be made in writing and signed by both parties.
b. Any notices under this Agreement shall be sent to the respective addresses of the parties mentioned above.

The Teacher

RECITALS

WHEREAS the Employer runs a school Syed Hyder Memorial Institute Hyderpora Srinagar, which is governed under the provisions of the Govt. of India and adheres to the educational standards set by the Constitution of India;
AND WHEREAS the Teacher has been selected by the Employer to perform teaching and other duties as outlined below;

NOW, THEREFORE, in consideration of the mutual covenants and promises set forth herein, the parties agree as follows:

1. APPOINTMENT AND TERM

The Employer hereby appoints the Teacher to serve as a [Designation, e.g., Class Teacher/Subject Teacher]________________________________ for the [academic year or term] ____________________, commencing from [Start Date]__________________ and ending on [End Date] ______________________, unless terminated earlier as per the conditions mentioned in this Agreement.

2. DUTIES AND RESPONSIBILITIES

The Teacher agrees to perform the following duties:

  • Teach the assigned subjects to students as per the curriculum prescribed by the Employer and

1.           Preparing lesson plans,

2.        Teaching according to the curriculum,

3.        Assessing student progress,

4.        Participating in school meetings and other responsibilities as may be assigned by the school.

  • Participate in administrative duties, meetings, and professional development activities as required.
  • Ensure a conducive learning environment by maintaining discipline and fostering positive student-teacher relationships.
  • Contribute to extra-curricular activities and events as may be requested by the Employer.
  • Adhere to the school’s policies and procedures, including those related to attendance, examination, and classroom management.

·         Teacher may be required to attend additional meetings, conferences, or professional development sessions as deemed necessary by the school.

  • The Teacher's performance will be subject to semi-annual reviews conducted by the school administration, with objectives established at the start of the academic year.

3. SALARY AND BENEFITS

  • The Teacher will be paid a monthly salary of [Amount] INR_____________________________, payable on the [Date]____________________________ of each month.

4. WORKING HOURS AND LEAVE

  • Working Hours: The Teacher’s regular working hours shall be as per the Timing set by school Authority.
  • Leave: The Teacher is entitled to ______ days of Sick leave per Month.

5. CODE OF CONDUCT AND ETHICAL STANDARDS

The Teacher shall adhere to the following:

  • Conduct themselves in a professional and respectful manner with students, parents, colleagues, and the community.
  • Abide by the moral and ethical standards in accordance with the values promoted by the Employer, which may be rooted in the religious and educational principles supported by the Govt. of India.
  • Comply with the relevant provisions of the Constitution of India, including respecting secularism, non-discrimination, and equality before the law.

6. TERMINATION

  • The Employer may terminate this Agreement by providing [Notice Period, e.g., 30 days] written notice to the Teacher.
  • The Employer may terminate this Agreement immediately for serious breaches of the contract, including but not limited to:
    • Violation of school policies or code of conduct.
    • Misconduct, unethical behavior, or any act that undermines the trust and integrity of the school environment.
  • In case of termination by the Teacher, they must fulfill the notice period unless otherwise mutually agreed.

·         Grounds for immediate Termination include gross misconduct, failure to perform duties as outlined, or breach of any terms contained within this Agreement.

7. DISPUTE RESOLUTION

  • Any disputes arising out of or in connection with this Agreement shall be resolved through mutual discussions between the Employer and the Teacher.
  • In case of failure to reach a resolution, the matter may be referred to a Dispute Resolution Committee constituted by the Employer, in accordance with the policies of the School. or the Law

8. CONFIDENTIALITY

  • The Teacher agrees to keep confidential any sensitive or proprietary information, including student data, school policies, and operational details, and shall not disclose it to any third party without prior written consent from the School Authority.

9. AMENDMENTS

  • Any amendments or modifications to this Agreement must be made in writing and signed by both the Employer and the Teacher.

10. GOVERNING LAW

  • This Agreement shall be governed by and construed in accordance with the laws of India, with special reference to the provisions set by the Auqaf Committee and the Constitution of India.

11.  Unauthorized Absenteeism

a)      Definition
Unauthorized absenteeism is defined as any absence from assigned duties without prior approval from the school administration, except in cases of emergencies or unavoidable circumstances, which must be communicated to the school immediately.

b)      Reporting Requirements

o    All planned absences must be approved in writing by the school administration at least ______ days  in advance.

o    In the case of emergencies or unforeseen circumstances, the teacher must notify the school as soon as possible, providing a valid reason for the absence.

c)      Consequences of Unauthorized Absenteeism
a. First Instance: A formal warning will be issued and recorded in the teacher’s personnel file.
b. Subsequent Instances: Repeated unauthorized absences will result in progressive disciplinary actions, which may include salary deductions, suspension, or termination of employment.

d)     Salary Deductions

o    For each day of unauthorized absence, a deduction will be made from the teacher’s salary in accordance with the school policies.

e)      Explanation and Appeal

o    Teachers may submit a written explanation for any unauthorized absence within five (5) working days of returning to work.

o    The school administration will review the explanation and decide whether to waive or uphold the consequences.

f)       Termination
Habitual or chronic unauthorized absenteeism that disrupts academic operations may result in termination of employment. A written notice will be served in accordance with the termination provisions outlined in this agreement.

g)      Acknowledgment
The teacher acknowledges understanding and acceptance of the above terms related to unauthorized absenteeism as part of this agreement.

12. ENTIRE AGREEMENT

  • This Agreement constitutes the entire understanding between the Employer and the Teacher with respect to the subject matter hereof and supersedes all prior agreements or understandings, whether written or oral.
